Judge Stephen Minor Grants Bail for David Snyder

Judge grants Snyder monetary bail of $400k

Judge Stephen P. B. Minor has granted bail in the case against David Snyder of Whitesville, NY, formerly of Genesee, PA.

Snyder, who is accused of operating a multi-million dollar cocaine distribution ring that stretched from New Jersey to the streets of Potter and Allegany counties, has been incarcerated in the Potter County jail since November 10.

A Writ of Habeas Corpus was filed on behalf of Snyder on December 9. The petition sought remedy from a previous bail denial by District Judge Delores G. Bristol, who denied bail under the premise that Snyder was a danger to society and witnesses.

Court records indicate that on December 13, Judge Stephen P. B. Minor granted a motion to modify bail, setting it at $400,000.

Also, a Preliminary Hearing scheduled for December 8 in the case has been continued until January 14, 2011.

Snyder is represented by attorney Joseph Marasco of Bradford, PA.

If this was the honest belief of Judge Bristol, why would Minor over-turn her decision? This is very concerning to us as a community. I pray for all of us who are not involved, but more so for the witnesses who are. I am wondering, have they placed the witnesses into protective custody or taken any measures to protect them while granting this man bail? More so, how can we as a community be certain that the bail money that was posted was clean? Can you tell dirty money from clean? Especially when the “ring” was said to have operated at over $2 MILLION DOLLARS?!!!

  2. thats 2 million in a very long period of time…. it doesnt actually add up to much in a good 6 years when there was many other people that got their chunk of it… And the reasoning i believe isnt that minor just overturned it.. i think it was more like daves lawyers doing and laws that apply to people in the us.

  4. Anonymous, perhaps I can clarify.

    First, David Snyder has not been released from jail as of the posting of this comment. Someone, presumably his attorney, filed a Writ of Habeas Corpus on his behalf.

    A Writ of Habeas Corpus is basically something that gives us all the ability to defend against unjust imprisonment. Now, I’m no attorney, but from what I understand this petition was filed challenging the denial of bail.

    Lets not forget, Mr. Snyder has not been convicted of a crime. Regardless of our opinions in the matter, it is ultimately up to the courts to determine whether or not Mr. Snyder is guilty. Until that happens, he is, under law, presumed to be ‘innocent until proven guilty’.

    With that said, there certainly are instances where the denial of bail is in order. However, I believe these cases are typically reserved for heinous crimes, such as murder etc., and even in some murder and/or rape cases the defendants are allowed to post bail.

    As for the statement that Bristol denied bail under the premise that Snyder is a danger to society and witnesses; this is what is listed in the court documents. It’s quite obvious that the prosecutor present at the time arguing against bail likely made those statements to strengthen his argument for bail not being posted. After all, that is his/her job.

    As for Judge Minor granting bail, this simply means that he has said, ‘okay, we’ll allow bail, but you need to come up with $400,000 to secure your return to court’.

    Basically this allows the court to say, ‘hey we did not infringe upon your rights, bail has been granted, good luck coming up with it’.

    Will Snyder come up with $400k? Personally, I think that is a very long shot.

    It is easy to say he operated a $2 million cocaine ring, but lets put that into perspective. $2 million distributed over the course of half a decade between possibly dozens of people…. people who likely had ‘habits’ of their own…. well I doubt there is $400k left amongst the lot of them.

    As for the witnesses, I can only speculate, but I would dare say the entire case rests on the testimony of one witness, who I believe is still incarcerated himself, and that of undercover drug agents.

    So, hopefully I have clarified the fact that Mr. Snyder is actually still in jail and possibly shed a bit of light on the rest matter. Keep in mind that much of this comment is my personal opinion and speculation on my part. It is not intended to be an extenuation of the article.

  5. Maybe his old friend ********** can lend him some DRUG money….They have been in the Business since the 70’s and any one from Bolivar NY can tell you some of those stories ..****** still as daughters in Bolivar…..maybe they can bail their Uncle out….

  6. Maybe his old buddy ********* will Bail him Out….They have been suppling the kids of Bolivar Drugs since 1970’s and any one from the Bolivar Richburg Friendship areas know these facts…why these 2 have not been put away years ago is beyond any reason…

  7. All five defendants, excluding David Snyder, waived their Preliminary Hearings.

    Judge Delores Bristol bound charges over from Snyder’s Preliminary Hearing, ruling that there was enough evidence to move forward.

    Four witnesses testified against Snyder, including his supplier Jorge Stuart, and Dustin Hurlburt, who has been incarcerated since 2007 on charges he sold cocaine for Snyder to an undercover agent.

    A Criminal Conference is scheduled for April 6.

    Both Stuart and Snyder remain incarcerated.

  8. Are you saying that Dave’s supplier, Jorge Stuart, testified against Dave? Dustin Hurlburt hasn’t been incarcerated the whole time from 2007, which he should have been! Actually this past year he’s been in a Center, where he can pretty much come and go as he pleases, gets free time to wander the streets of Erie, go look for a job, get welfare and foodstamps, etc. And this is Punishment???

    You must know him personally to know all of this information.
    I can testify he has been incarcerated, and does not walk the streets of Erie, or any of the other stuff you mentioned above, I’ve talk with his councelor and the center where he is at. He is indeed incarcerated. He does not have the freedoms you are mentioning. Are you related to him and do you have inside information the rest of us dont have?

  10. Not sure if anyone has any idea of the cost to keep this idiot in jail.. But if he can come up with the money take it.. Put a shackle around his leg and if he leave his house throw the key away..
