STATE COLLEGE – A Texas man has been sentenced to state prison on charges of homicide by vehicle and DUI in connection to a crash that killed his passenger in 2009.

Police said Shayne A. Breaux was driving with a blood alcohol content level of .242 when he crashed and rolled his Ford Explorer on November 17, 2009 near an entrance ramp to I-99.

Breaux was sentenced today to a maximum of three-and-half to seven years in prison as part of a plea agreement in Judge Bradley S. Lunsford’s courtroom.

Killed in the crash was 24-year-old Brock Choate, who was ejected from the vehicle and then ran over by a tractor-trailer.

Breaux originally denied operating the vehicle, but two of his three passengers told police he was driving and intentionally swerving before the crash.
