Man Sentenced to Jail for Selling Fake Heroin

COUDERSPORT – A New York man has been sentenced to jail in Potter County after he sold counterfeit heroin to a confidential police informant.

James R. Freaney, Jr., 37, of Great Valley, NY, was sentenced on Wednesday, February 8 to serve 29 days to 9 months in jail on one count of Possession of a Controlled Substance(M). Freaney was also sentenced to 36 months of probation on one count of selling counterfeit controlled substances(F) and fined a total of $400. He was also ordered to reimburse the District Attorney’s office in the amount of $750 and to pay a local lab fee of $113.

Freany was arrested after he sold 4 ounces of a substance for $700 to an undercover state police agent and confidential informant at the Potter County fairgrounds in April of 2009.

The substance, which Freany told his buyers was red rock heroin, was later determined by an Erie laboratory to contain no controlled substances. Police later charged him with selling counterfeit controlled substances; a felony.

Freaney was also ordered to pay several miscellaneous fees, participate in AA and/or NA meetings as directed, take part in a DUI Victim Impact Panel Presentation and to comply with all mental health recommendations.
