Dustin Mahon Sentenced

On February 15, 2012, Dustin Mahon was sentenced in the Court of Common Pleas, Potter County, Docket No. 232 of 2010 as follows:

  • As to Count 1, DUI, Third Offense, the defendant was scheduled to incarceration with the Bureau of Corrections for a period of not less than 12 months nor  more than 60 months.  He will pay a fine of $2500.00.
  • As to Count 5, Driving While Suspended, the defendant is sentenced to a concurrent term of incarceration with the Bureau of Corrections for a period of 60 days, to run concurrent with Count 1.  He will pay a fine of $500.00.  This sentence will run consecutive to the sentence imposed this day at No. 87 of 2011.
  • As to Counts 1 & 5 the defendant is eligible for a Recividism Risk Reduction Incentive (RRRI) Sentence.

The defendant shall pay costs of the court.  He shall pay a supervision fee of $25.00 per month and an administrative fee of $20.00 per month for all time spent on probation/parole.   The defendant shall perform 25 hours of community service for Potter County, and pay insurance costs.  The defendant shall pay Local Lab Reimbursement of $74.00.  The defendant shall pay DA Expense Reimbursement of $153.00.   The defendant will pay a Court Reporting Network Test Fee in the amount of $100.00.  The defendant will pay an Act 198 fee of $100.00.  He will be the subject of a comprehensive drug and alcohol evaluation and comply with all treatment recommendations relative to drug and alcohol abuse, at his own expense, and will attend AA or NA meetings as directed.

  •  As to Count 3-DUI, Controlled Substance, Schedule I, Third Offense, the defendant was scheduled to incarceration with the Bureau of Corrections for a period of not less than 12 months nor  more than 60 months.  He will pay a fine of $2500.00.  His license will be suspended for a period of 18 months.
  • As to Count 5-Driving While BAC .02 or Greater While License Suspended, the defendant was sentenced to a term of incarceration with the Bureau of Correction,s consecutive to Count 3, for a period of 90 days.  He will pay a fine of $1000.00.
  • As to Counts 3 & 5 the defendant is eligible for a Recividism Risk Reduction Incentive (RRRI) Sentence .
