2 min readOn April 11, 2012, in the Court of Common Pleas, No. 268-2011, Amy Payne received the following sentence:
As to Count 2: Criminal Trespass(F3) Serve a term of not less than 5 nor more than 18 months incarceration. Pay fine of $500.00.
As to Count 4: Receiving Stolen Property (M1) Serve a term of one year probation which will be consecutive to Count 2. Pay a fine of $300.00.
The defendant will pay the costs of court. The defendant shall pay a supervision fee of $25 per month, and an administrative fee of $20 per month for all the time spent on probation/parole.
The defendant will perform 20 hours of community service for Potter County at the discretion of Probation and the defendant shall be responsible for the cost of insurance regarding his/her participation; or The defendant will make a monetary donation to the Food Bank in lieu of performing 20 hours of community service. Dollar amount will be set by Probation. The defendant shall pay restitution to the victim(s ) of $1,000.00. Restitution Priority is set at 50% (Potter County’s standard priority). Objections and/or additions to restitution must be filed by Defense and/or Prosecution within 10 days. Restitution shall be paid in full within 6 months. The defendant shall pay DA Expense Reimbursement of $386.00 which the DA shall pay to the Harrisburg State Police. Extradition cost of $1,015.80 shall be paid by the defendant. The defendant shall receive credit for time served, if any. The defendant shall be paroled at the expiration of his/her minimum sentence if he/she is of good behavior. The defendant will comply with all terms and conditions of parole or probation, including the following special conditions: The defendant will meet with the Potter County Probation Dept. today after her release from incarceration. The defendant will be the subject of a comprehensive Drug and Alcohol Evaluation and comply with all treatment recommendations relative to drug and alcohol abuse, at his/her own expense. The defendant having been the subject of a D & A evaluation will take part in recommended treatment programs relative to drug or alcohol abuse, at his/her own expense. The defendant will attend AA and/or NA meetings as directed. The defendant is subject to mandatory DNA testing and will pay the $250.00 for same. The defendant is to have no contact with the victim(s) of his/her crime.
