John Brackett was sentenced February 15th, 2012 in the Court of Common Pleas of Potter County, Pennsylvania, Docket No.104-2009, Criminal Division as follows:

As to Count 1, DUI, General Impairment, Second Offense, he will be incarcerated in the Potter County Jail for a term of not less than 12 nor more than 60 months and will pay a fine of $2500.00.

As to Count 4, Retail Theft, he will pay a fine of $300.00.

As to Count 5, Public Drunkenness, he will pay a fine of $300.00.

As to Count 6, Failure to Carry Registration, he will pay a fine of $25.00.

As to Count 7, Driving Without A License, he will pay a fine of $200.00.

As to Count 8, Failure to Carry A License, he will pay a fine of $25.00.

As to Count 9, Turning Movements and Required Signals, he will pay a fine of $25.00.

As to Count 10, Careless Driving, he will pay a fine of $25.00.

As to Count 11, Failure to Use Safety Belt System, he will pa a fine of $10.00.

As to Count 12, Investigation by Officer/Duty of operator, he will pay a fine of 25.00.

He will pay all costs of court: a supervision fee of $25 per month and administrative fee of $20 per month for all time spent on probation.  He will perform 25 hours of community service for Potter County and be responsible for the cost of insurance regarding his participation or make a monetary donation to the Food Bank in lieu of performing 25 hours of community service.  He is ordered to pay the Erie Crime Lab Fee Reimbursement of $113.00.  He will not be paroled at the expiration of his minimum sentence and must file a petition for the same.  He is not work release eligible at this time.  He will receive credit for time served.  He  must also comply with all terms and conditions or parole or probation, including the following special conditions:  He must pay a fee of $300 under Act 198.  He will also pay a Court Reporting Network fee of $100.00.  He will attend DUI Alcohol Safe Driving School and be responsible for the cost thereof.   Having also been the subject of a comprehensive drug and alcohol evaluation, he will take part in treatment recommendations relative to drug and alcohol abuse, at his own expense.  He will attend AA and/or NA meetings as directed.   He must take part in the Potter County DUI Victim Impact Panel Presentation to be held on Monday, March 19, 2012 at 7:00 p..m. in the courtroom.  He will pay a fee of $35.00 to defray cost, payable at the time of the presentation.  His participation and attendance are mandatory, and he must not be under the influence of alcohol or any substance at the time of attendance.  Sentencing to certain offenses may make the defendant subject to applicable driver’s license suspensions and/or ignition interlock device requirements; these are assessed by PennDOT.

As to Count 2, DUI – Tier 3 – Second Offense, he is to serve a concurrent term to Docket No. 104-2009 of 12 to 60 months of incarceration and pay a fine of $1500.00.

As to Count 3, Driving Without a License, he is to pay a fine of $200.00.

As to Count 4, Disregard Traffic Lane, he will pay a fine of $25.00.

As to Count 5, Careless Driving, he will pay a fine of $25.00.

He will pay all costs of court: a supervision fee of $25 per month and administrative fee of $20 per month for all time spent on probation.  He will perform 20 hours of community service for Potter County and be responsible for the cost of insurance regarding his participation.  He may be released to Community Service at the discretion of the Sheriff.   He will make a monetary donation to the Food Bank in lieu of performing 20 hours of community service.  Dollar amount will be set by Probation.  He is ordered to pay the Local Lab Fee Reimbursement fee of $74.00.  He shall receive credit for time served.  He will not be eligible for work release.  He  must also comply with all terms and conditions or parole or probation, including the following special conditions:  He must pay a fee of $300 under Act 198.  Having also been the subject of a comprehensive drug and alcohol evaluation, he will take part in treatment recommendations relative to drug and alcohol abuse, at his own expense.
