On March 21, 2012, in the Court of Common Pleas, No. 277-2011, Lewis C. Rudacille, Jr. received the following sentence:

And now this  21st day of March the Motion of the Commonwealth for Accelerated Rehabilitative Disposition is granted.  Further proceedings on the charges contained in Counts 1&2 of the Information shall be postponed during the term of the program as outlined.  The defendant will pay the costs of court and a fee in the amount of $350 to cover the cost of his/her participation in the ARD program.  The defendant shall pay a supervision fee of $25 per month, and an administrative fee of $20 per month.  The defendant will be supervised by the Potter County Office of Adult Probation for a period of  12 months and be subject to the following terms and conditions:

  • PA Driver’s License shall be suspended for a period of 60 days.
  • The defendant shall absolutely refrain from the consumption of illegal drugs or intoxicating beverages and be of good behavior at all times.
  • The defendant will attend DUI Alcohol Safe Driving School and be responsible for the cost thereof.
  • The defendant will be the subject of a comprehensive Drug and Alcohol Evaluation and comply with all treatment recommendations relative to drug and alcohol abuse, at  his/her own expense.
  • The defendant will perform 25 hours of community service for Potter County and shall be responsible for the cost of insurance regarding his/her participation.
  • The defendant will pay all costs of court and all other fees as directed by the Potter County Office of Adult Probation, including Local Lab Fee Reimbursement to the County of  $74.00 and prosecution costs to the District Attorney’s Office in the amount of $158.00.  The defendant will also pay a Court Reporting Network Test Fee in the amount of $35.00.
  • The defendant will pay a fee of $100 under Act 198.
  • The defendant will obey all laws of the United States of America, the Commonwealth of Pennsylvania, together with all other states and political subdivisions thereof.
  • The defendant will comply with all other terms and conditions of supervision such as are set forth from time to time by the Potter County Office of Adult Probation.
  • The defendant is sentenced to take part in the next available Victim Impact Panel Presentation in his/her own county, and his/her own expense.  Defendant is to contact probation in his/her home county to make arrangements for same within 10 days.  Proof of his/her participation in said presentation to be submitted to Potter County Probation within 10 days.

The defendant pleads guilty to the following summary charges and is sentenced to pay the following fines together with appropriate costs as follows:

Cnt.3:Inv.by Officer (S) fine of $25.00

Cnt.4:Disregard Traffic Lane (S) fine of $25.00

Cnt5:Turning Movem.&Req.Signals (S) fine of $25.00

Cnt6:Careless Driving (S) fine of $25.00

Cnt7:Periods For Req.Lighted Lamps anytime with wipers on (S) fine of $25.00
