Retired state Trooper David M. O’Brien once was cited for his “extraordinary heroism” in the successful capture of the Olean High School sniper in December 1974.
But O’Brien now sits in state prison, as his attorney last week launched a federal court action to get him released and a new trial in the death of a Pennsylvania woman in a late-night crash on Route 219 in 2008.
Edward C. Cosgrove said he hopes the action will be quickly assigned to a U.S. District Court judge in Buffalo, so arguments can be heard before the end of this month. The 72-year-old O’Brien, of Allegany, remains in the state’s Mid-State Correctional Facility in Marcy.
